Disputes

Any dispute or claim arising under or relating in any way to your use of this site, or to any products or services sold or distributed by LawsuitAnalysis.com, is to be settled by binding arbitration via remote online platform under the laws of the state of California. Before initiating arbitration, the user agrees to email [email protected] with the dispute information and negotiate in good faith for a 10 day period to attempt to resolve the dispute. If not resolved, the arbitration shall be conducted on a confidential basis pursuant to the Commercial Arbitration Rules of the American Arbitration Association.

Any decision or award as a result of any such arbitration proceeding shall be in writing and shall provide an explanation for all conclusions of law and fact and shall include the assessments of costs, expenses, and reasonable attorneys’ fees. Any such arbitration shall include a written record of the arbitration hearing. An award of arbitration may be confirmed in a court of competent jurisdiction.

To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to our registered agent: Registered Agents c/o Help Yourself Solutions, LLC, 7901 4th St N, STE 300, St. Petersburg, FL 33702.  The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, which are available at www.adr.org or by calling 1-800-778-7879. Payment of filing, administration and arbitrator fees will be governed by the AAA’s rules.

JURISDICTION | GENERAL TERMS

You agree that no joint venture, partnership, employment or agency relationship exists between you and LawsuitAnalysis.com as a result of this agreement or use of the Site.

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law, including but limited to the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of the Agreement shall continue in effect.

Unless otherwise specified herein, this agreement and the linked Privacy Statement & Cookie Policy constitutes the entire agreement between the user and LawsuitAnalysis.com with respect to the Site, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and LawsuitAnalysis.com with respect to the Site.

A printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish of the parties that this Agreement and all related documents be written in English.
